Diese Allgemeinen Geschäftsbedingungen ("AGB") regeln den Kauf von Waren über den Onlineshop she-shapes.com ("Shop"), betrieben von der Milow Studios GmbH unter der Marke She Shapes. Sie gelten für alle Bestellungen, die Verbraucherinnen und Verbraucher mit Wohnsitz in der Schweiz, in Deutschland oder in Österreich über den Shop aufgeben.

2. Geltungsbereich und Vertragssprache
Diese AGB gelten in ihrer zum Zeitpunkt der Bestellung gültigen Fassung. Der Vertrag kann in deutscher oder englischer Sprache abgeschlossen werden.
3. Vertragsschluss
Die Darstellung der Produkte im Shop stellt kein rechtlich bindendes Angebot unsererseits dar, sondern eine unverbindliche Aufforderung an Sie, ein Angebot abzugeben ("invitatio ad offerendum").
Mit dem Absenden Ihrer Bestellung über den Bestellvorgang im Shop geben Sie ein verbindliches Angebot zum Abschluss eines Kaufvertrags ab. Unmittelbar nach Absenden der Bestellung erhalten Sie eine automatische Eingangsbestätigung per E-Mail; diese stellt noch keine Annahme Ihres Angebots dar. Der Kaufvertrag kommt erst zustande, wenn wir Ihre Bestellung durch eine gesonderte Bestätigung ausdrücklich annehmen oder die Ware an Sie versenden.
Wir behalten uns vor, Bestellungen nicht anzunehmen, etwa wenn eine Ware nicht verfügbar ist oder Anhaltspunkte für einen Irrtum oder Missbrauch vorliegen.
4. Preise, Versandkosten und Mehrwertsteuer
Es gelten die im Shop zum Zeitpunkt der Bestellung angezeigten Preise. Alle angezeigten Preise sind Endpreise und enthalten die jeweils gesetzlich geschuldete Mehrwertsteuer bzw. Umsatzsteuer des Lieferlands, sofern im Bestellvorgang nicht ausdrücklich anders ausgewiesen.
Versandkosten werden, sofern nicht bereits im angezeigten Preis enthalten, vor Abschluss der Bestellung gesondert ausgewiesen und sind von Ihnen zusätzlich zu tragen.
5. Zahlung
Die Zahlung erfolgt über die im Bestellvorgang angebotenen Zahlungsmethoden. Der Rechnungsbetrag wird, sofern nichts anderes angegeben ist, mit Abschluss der Bestellung fällig und eingezogen. Dies gilt auch für Vorbestellungen ("Pre-Sale", siehe Ziffer 7) – die Zahlung erfolgt hier bereits bei Bestellabschluss und nicht erst bei Versand.
6. Lieferung
Die von uns angegebenen Liefertermine und Lieferfristen sind sorgfältig kalkulierte Schätzungen und keine im Einzelfall zugesicherten Fixtermine, es sei denn, wir bezeichnen einen Termin ausdrücklich und schriftlich als verbindlich. Wir bemühen uns, die angegebenen Zeiträume einzuhalten, und informieren Sie unverzüglich, sobald uns eine erhebliche Verzögerung bekannt wird.
Die Gefahr des zufälligen Untergangs und der zufälligen Verschlechterung der Ware geht bei Verträgen mit Verbraucherinnen und Verbrauchern erst mit der tatsächlichen Übergabe der Ware an Sie oder an eine von Ihnen benannte, vom Beförderer verschiedene Person über – nicht bereits mit der Übergabe an den Versanddienstleister.
7. Vorbestellungen ("Pre-Sale")
Produkte, die im Shop als "Pre-Sale" oder Vorbestellung gekennzeichnet sind, werden erst nach Abschluss der Produktion an unseren Versanddienstleister übergeben. Der auf der Produktseite genannte Zeitraum ("voraussichtlicher Versand") bezeichnet den Zeitpunkt, zu dem wir die Ware voraussichtlich zum Versand aufgeben – er umfasst nicht die anschliessende, gesondert hinzukommende Transportdauer bis zur Zustellung an Sie, die von der gewählten Versandart und dem Zielland abhängt.
Sollte sich der angekündigte Versandzeitraum erheblich verzögern, informieren wir Sie proaktiv per E-Mail und bieten Ihnen die Möglichkeit, die Bestellung kostenfrei zu stornieren und den vollständigen Kaufpreis erstattet zu bekommen.
8. Widerrufsrecht, freiwillige Rückgabe und Gewährleistung
Diese drei Rechte bestehen unabhängig nebeneinander und schliessen sich nicht gegenseitig aus:
- Gesetzliches Widerrufsrecht: Als Verbraucherin bzw. Verbraucher in der EU steht Ihnen ein 14-tägiges Widerrufsrecht zu. Details siehe Widerrufsbelehrung.
- Freiwillige 30-Tage-Rückgabe: Zusätzlich gewähren wir freiwillig ein 30-tägiges Rückgabefenster. Details siehe Versand & Rückgabe.
- Gesetzliche Gewährleistung (Mängelrechte): Für Mängel der Ware haften wir nach den zwingenden gesetzlichen Vorschriften. Diese Rechte bestehen unabhängig von den beiden vorgenannten Rückgabemöglichkeiten und werden durch diese nicht eingeschränkt.
9. Eigentumsvorbehalt
Die gelieferte Ware bleibt bis zur vollständigen Bezahlung unser Eigentum.
10. Geistiges Eigentum
Alle Inhalte des Shops – einschliesslich Texte, Bilder, Grafiken und Design – sind Eigentum der Milow Studios GmbH oder ihrer Lizenzgeber und urheberrechtlich geschützt. Eine Nutzung über das für den privaten Einkauf notwendige Mass hinaus ist ohne unsere vorherige Zustimmung nicht gestattet.
11. Haftung
Wir haften unbeschränkt für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, die auf einer vorsätzlichen oder fahrlässigen Pflichtverletzung beruhen, sowie für sonstige Schäden, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung beruhen. Ebenso unbeschränkt haften wir nach den Vorschriften des Produkthaftungsgesetzes sowie im Umfang einer von uns ausdrücklich übernommenen Garantie und für sonstige Ansprüche, die gesetzlich zwingend nicht ausgeschlossen oder beschränkt werden dürfen.
Bei leicht fahrlässiger Verletzung einer wesentlichen Vertragspflicht (Kardinalpflicht) – also einer Pflicht, deren Erfüllung die ordnungsgemässe Durchführung des Vertrags überhaupt erst ermöglicht und auf deren Einhaltung Sie regelmässig vertrauen dürfen – ist unsere Haftung auf den vertragstypischen, vorhersehbaren Schaden begrenzt. Im Übrigen ist die Haftung für leicht fahrlässige Pflichtverletzungen ausgeschlossen.
Wir übernehmen keine Haftung für Farbabweichungen der Produktabbildungen, die durch unterschiedliche Bildschirmeinstellungen der Endgeräte bedingt sind.
12. Anwendbares Recht und Gerichtsstand
Auf diesen Vertrag findet schweizerisches Recht Anwendung. Haben Sie als Verbraucherin bzw. Verbraucher Ihren gewöhnlichen Aufenthalt in einem Mitgliedstaat der Europäischen Union, bleiben die zwingenden verbraucherschützenden Bestimmungen des Rechts dieses Staates von dieser Rechtswahl unberührt, soweit diese Ihnen einen weitergehenden Schutz gewähren als das schweizerische Recht.
Gerichtsstand für Streitigkeiten mit Kaufleuten, juristischen Personen des öffentlichen Rechts oder öffentlich-rechtlichen Sondervermögen ist Bazenheid, Schweiz. Für Verbraucherinnen und Verbraucher gelten daneben die gesetzlichen, zwingenden Gerichtsstandsbestimmungen ihres jeweiligen Wohnsitzstaates unverändert fort.
13. Änderungen dieser AGB
Wir behalten uns vor, diese AGB mit Wirkung für die Zukunft zu ändern. Für bereits abgeschlossene Verträge gilt die zum Zeitpunkt der jeweiligen Bestellung gültige Fassung.
14. Salvatorische Klausel
Sollte eine Bestimmung dieser AGB unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen davon unberührt.

These Terms & Conditions ("Terms") govern the purchase of goods through the online shop she-shapes.com (the "Shop"), operated by Milow Studios GmbH under the brand She Shapes. They apply to all orders placed through the Shop by consumers resident in Switzerland, Germany, or Austria.

2. Scope and contract language
These Terms apply in the version valid at the time of your order. The contract may be concluded in German or English.
3. Formation of contract
The presentation of products in the Shop does not constitute a legally binding offer on our part, but a non-binding invitation for you to place an order ("invitation to treat").
By submitting your order through the Shop's ordering process, you make a binding offer to enter into a purchase contract. You will receive an automatic order-received confirmation by email immediately after submitting your order; this does not yet constitute acceptance of your offer. The purchase contract is only formed once we expressly confirm acceptance of your order in a separate message, or once we ship the goods to you.
We reserve the right not to accept an order, for example if a product is unavailable or there are indications of an error or misuse.
4. Prices, shipping costs and VAT
The prices shown in the Shop at the time of your order apply. All displayed prices are final prices and include the statutory value-added tax applicable in the destination country, unless expressly stated otherwise during checkout.
Shipping costs, unless already included in the displayed price, are shown separately before you complete your order and are payable by you in addition.
5. Payment
Payment is made using the payment methods offered during checkout. Unless stated otherwise, the invoice amount is due and charged upon completion of your order. This also applies to pre-orders ("pre-sale", see Section 7) – payment is collected at the time you place the order, not at the time of shipping.
6. Delivery
Delivery dates and periods we provide are carefully calculated estimates, not fixed dates guaranteed in each individual case, unless we expressly designate a date as binding in writing. We make reasonable efforts to meet the stated timeframes and will inform you without undue delay as soon as we become aware of a significant delay.
For contracts with consumers, risk of accidental loss of, or accidental damage to, the goods only passes to you upon actual handover of the goods to you or to a third party designated by you other than the carrier – not already upon handover to the shipping carrier.
7. Pre-orders ("pre-sale")
Products marked in the Shop as "pre-sale" or pre-order are handed over to our shipping carrier only after production is complete. The timeframe stated on the product page ("estimated shipping") refers to the point at which we expect to hand the goods to the carrier – it does not include the subsequent, separate transport time until delivery to you, which depends on the shipping method chosen and the destination country.
Should the announced shipping window be significantly delayed, we will proactively notify you by email and offer you the option to cancel your order free of charge for a full refund.
8. Right of withdrawal, voluntary return policy, and warranty
These three rights exist independently of one another and do not exclude each other:
- Statutory right of withdrawal: As an EU consumer, you have a 14-day right of withdrawal. See Right of Withdrawal for details.
- Voluntary 30-day return policy: We additionally grant a voluntary 30-day return window. See Shipping & Returns for details.
- Statutory warranty: We are liable for defects in the goods in accordance with mandatory statutory provisions. These rights exist independently of, and are not limited by, either of the two return options above.
9. Retention of title
Delivered goods remain our property until paid for in full.
10. Intellectual property
All content on the Shop – including text, images, graphics, and design – is the property of Milow Studios GmbH or its licensors and is protected by copyright. Use beyond what is necessary for private shopping purposes is not permitted without our prior consent.
11. Liability
We are liable without limitation for damages resulting from injury to life, body, or health caused by an intentional or negligent breach of duty, and for any other damages caused by an intentional or grossly negligent breach of duty. We are equally liable without limitation under applicable product liability law, to the extent of any guarantee we have expressly given, and for any other claims that cannot be lawfully excluded or limited.
For slightly negligent breaches of a material contractual obligation (an obligation whose fulfilment is essential to the proper performance of the contract and on whose observance you may regularly rely), our liability is limited to foreseeable damage typical for this type of contract. Liability for slightly negligent breaches of all other obligations is excluded.
We accept no liability for colour variations in product images caused by differing screen settings on end devices.
12. Governing law and jurisdiction
This contract is governed by the laws of Switzerland. If you are a consumer with your habitual residence in a member state of the European Union, mandatory consumer-protection provisions of the law of that state remain unaffected by this choice of law, to the extent they grant you more extensive protection than Swiss law.
The place of jurisdiction for disputes with merchants, legal entities under public law, or special public-law funds is Bazenheid, Switzerland. For consumers, the mandatory statutory jurisdiction rules of their respective country of residence continue to apply unchanged alongside this.
13. Changes to these Terms
We reserve the right to amend these Terms with effect for the future. For contracts already concluded, the version valid at the time of the respective order applies.
14. Severability
Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
